Booking Terms & Conditions

The terms below govern every booking made with Drop Into Wild Safaris. Please read them carefully before confirming your trip.

In this Agreement, the following words have the meanings given below, unless the context clearly indicates otherwise:

"Safari Consultant"
means a travel adviser employed by Drop into Wild Safaris;
"the Agreement"
means the Customer Booking Form (defined below) read together with the applicable Customer Quotation and these Terms and Conditions;
"Customer Quotation"
means the itinerary or quotation sent to you by Drop into Wild Safaris, indicating the estimated prices of the travel products and services you wish to purchase;
"the Customer Booking Form"
means the form completed and submitted by you confirming your acceptance of the Customer Quotation;
"CPA"
means the Consumer Protection Act, No. 46 of 2012 (Kenya);
"Day"
means a calendar day;
"Departure Date"
means the date on which you start your travels, as indicated on the Customer Confirmation Form;
"Deposit"
means the monies payable by you to Drop into Wild Safaris to secure your booking;
"Force Majeure"
means any extraordinary event or circumstance beyond the control of the parties, including but not limited to war, riot, civil unrest, terrorist activity, industrial action, natural or other disaster, adverse weather, pandemics or epidemics (including government regulations or interventions in response to these), and fire;
"Drop into Wild Safaris"
means Drop into Wild Safaris Limited , duly registered and carrying on business at Diani, Kenya, and licensed by the Tourism Regulatory Authority (TRA);
"Involuntary Change"
means a change to a booking caused by scheduled airline failure, adverse weather, airline or airport disruption, and other Force Majeure events;
"in writing"
means written communication sent to Drop into Wild Safaris by email or recorded post;
"You/Your"
means the client described on the Customer Booking Form;
"Voluntary Change"
means a change requested by you that is not an Involuntary Change, and which may result in additional costs including cancellation, amendment, or administration fees, and the cost of new services;
"Overbooking Displacement"
means the cancellation or rescheduling of a service by a Supplier due to a booking error on the Supplier's part;
"Parties"
means both you and Drop into Wild Safaris;
"Supplier"
means a third party who supplies you with travel services, including but not limited to airlines, transfer companies, car rental companies, lodges, camps, hotels, and conservancy or park authorities;
"Supplier Schedule Failure"
means a Supplier's failure to provide travel services as booked, including Overbooking Displacement;
"Scheduled Airline Failure"
means an airline's failure to operate, or to operate to schedule, for reasons including technical failure or weather;
"Service Fee"
means the portion of your Total Confirmed Price covering services provided by Drop into Wild Safaris, including booking, administration, communication, amendment, cancellation, and bank charges;
"Total Confirmed Price"
means the total cost of the services rendered to you by or on behalf of Drop into Wild Safaris, as shown on the Customer Confirmation Form;

Words in the singular include the plural, and vice versa; and

Pronouns of any gender include the other genders.

PART A: YOUR DEALINGS WITH DROP INTO WILD SAFARIS IN RESPECT OF TRAVEL SERVICES AND PRODUCTS OFFERED BY SUPPLIERS

1. Securing Your Booking

  1. To confirm your booking, the following payments are due to Drop into Wild Safaris:

    1. A 30% deposit at the time of booking — except for air travel, which requires 100% payment on booking since tickets must be issued immediately, and exclusive-use villa/house bookings, which require a 50% deposit;
    2. The final balance, due 60 days before travel;
    3. 100% of the Total Confirmed Price for bookings made less than 60 days before departure;
    4. A higher deposit may be required for specialist products or peak-season travel.
  2. If payments are not received as set out above, Drop into Wild Safaris will be unable to confirm your booking.

2. Prices and Payment

  1. You are liable for the Total Confirmed Price, less any payments already made, plus any additional charges arising from booking changes as set out in clause 4.

  2. Payments may be made by credit/debit card, bank/wire transfer (SWIFT), or M-Pesa, as advised by your Safari Consultant. Payments are typically cleared within five business days. Cash on arrival and traveller's cheques are not accepted for securing bookings.

  3. If payment is not received by the due date, your booking will be cancelled and the relevant deposit forfeited in accordance with clause 1 above.

3. Price Increases

  1. Quotations and Confirmation Forms are based on external Supplier costs — such as airfares, airport taxes, fuel surcharges, accommodation rates, vehicle hire, park entry and conservancy fees — which are outside the control of Drop into Wild Safaris and remain subject to change until final payment is received or, for air travel, until tickets are issued.

  2. Any increase in such costs will be charged to you and is payable to Drop into Wild Safaris, or as otherwise instructed.

  3. You further acknowledge that:

    1. Airlines may levy additional taxes or fuel surcharges without notice at any time before departure; any resulting increase is payable by you;
    2. Transfer and vehicle-hire companies may levy additional charges due to fuel price increases or government levies; any resulting increase is payable by you;
    3. Government bodies, county authorities, conservancies, and the Kenya Wildlife Service (KWS) may increase park, conservancy, or gate fees without notice; any resulting increase is payable by you.

4. Changes to Bookings

  1. Drop into Wild Safaris will make every effort to honour the confirmed itinerary. Where an Involuntary Change is significant — such as a change of accommodation or transport — we will:

    1. Provide a reasonable alternative at no additional cost, subject to the relevant Supplier's terms; or
    2. Where you reject the alternative, or none is available, refund the monies affected by the Involuntary Change, subject to the relevant Supplier's terms.
  2. Where a refund is due, we will assist you in sourcing alternative services, with any additional cost for your account.

  3. For a Voluntary Change, Drop into Wild Safaris will use reasonable efforts to accommodate your request, but reserves the right to charge the applicable cancellation fees under clause 7, plus an administration fee , together with any additional Supplier costs.

5. Travel Deals and Discounted Rates

Special offers and discounted rates advertised on our website or in a Customer Quotation may carry separate terms set by the relevant Supplier. It is your responsibility to obtain and review these, as you will be bound by them.

6. Waiver, Indemnity, and Liability

  1. Vouchers, receipts, and tickets issued by Drop into Wild Safaris are subject to the relevant Supplier's terms and conditions.

  2. Participation in any safari, tour, or activity arranged by Drop into Wild Safaris and delivered by a Supplier — including transport to and from any venue, and wildlife-viewing activities of any kind — is undertaken at your own risk.

  3. You indemnify Drop into Wild Safaris and its directors, employees, and agents against any claim for damage or loss arising from or connected with the services described in this Agreement.

  4. You, and your heirs, dependants, agents, executors, or assignees, irrevocably waive any claim against Drop into Wild Safaris for compensation or damages arising from injury, illness, or death of any nature — including where caused by your own actions — suffered while on tour, in a vehicle, at any location during the tour, or at any time afterwards.

7. Cancellation and Refund Policy

  1. If you cancel your booking, in full or in part, for any reason, Drop into Wild Safaris will apply the cancellation charges set out below. Where we are occasionally able to obtain a waiver of cancellation fees or an ex-gratia refund from a Supplier, we will pass this on to you, less our Service Fee — though we cannot guarantee this outcome.

  2. Cancellations must be made in writing. Where sent by email, please obtain a delivery/read receipt and retain our written acknowledgement.

  3. Cancellation charges:

    • 61+ days before departure: Deposit non-refundable
    • 0–60 days before departure: 100% cancellation fee
  4. Should Drop into Wild Safaris be unable to confirm the requested itinerary after deposit payment, we will offer an alternative. If the alternative is not acceptable to you, a full refund will be provided.

  5. We reserve the right to cancel services where unavoidable due to circumstances beyond our control. In such cases, we will provide a full refund for the cancelled service(s) only, except in Force Majeure events.

  6. We reserve the right to cancel a reservation without liability where an obvious quotation error or omission has a material cost impact.

  7. No refunds are given for partly used vouchers or no-shows.

8. Complaints and Dispute Resolution

  1. Complaints should be reported to Drop into Wild Safaris by phone at the time of the incident, and followed up in writing no later than 30 days after the incident.

  2. Written complaints should be sent to [postal address], Diani, Kenya, or by email to [complaints email].

  3. We will acknowledge your complaint and aim to investigate it with the relevant Supplier within 30 days, after which we will provide written feedback.

  4. While we will make every reasonable effort to assist in resolving your complaint, we cannot guarantee resolution of matters relating to services or products outside our control and for which we are not responsible.
